Law of Surrogacy in Delhi

There is no such law is associated with Surrogacy in Delhi procedure but both the parties need to sign a contract which states that surrogate will carry your baby in her womb for 9 months and then hand over the baby after the baby born to his/her intended parents. On the other hand, intended parents need to sign a contract which states that they will bear all the expenses of the surrogates including her food, accommodation, clothing, legal charges etc.

The intended parents also need to file a petition on the third day of the baby born for seeking the Court permission to be a legal parents of baby born and the Court will then orders the Department of Vital Statistics to issue a new birth certificate which states the name of intended parents as the legal parents of the baby born and surrogate has no relationship left with baby born.
